Any rental arrangement implies a lease contract between a lessor (usually the owner of the building being rented out), and a tenant relating to the possession of a building, subject to the payment of a rent.

If you rent a property ‘furnished’, this will include not only the furniture, but also the kitchen utensils, crockery and bed covers. It will not normally include sheets, towels, tea towels, etc. Ask for an inventory ; this will offer you protection in the event of a dispute. If you rent ‘unfurnished’, you should be aware that the majority of decent apartments include kitchen appliances but that curtains, curtain rails, carpets and light fixtures (ceiling lamps, wall lamps etc) are usually not included.

Leases

The duration of the lease

Any lease contract has a fixed duration, which in principle is 9 years. There are three other options :

On expiry of the period fixed in the contract, the tenant and the landlord may each terminate the contract.

3 months’ notice must be given before the deadline in the case of a short-term lease and 6 months in other cases.  

The landlord may terminate the lease contract in order to occupy the premises himself or to have works carried out on his property. In the event of the termination of the contract without a legal basis, the owner will be required to pay the tenant compensation.

The tenant may terminate the lease at any time, provided that he gives the landlord 3 months’ notice. If this happens within the first 3 years of the lease, he must pay compensation.

The amount of the rent

The rent is established by the parties at their discretion.  

The rent may be indexed once a year on the date of entry into force of the lease. Indexation permits adapting the rent to the cost of living according to the official index fixed by the State. It is available on internet

This indexation is not automatic : the landlord must advise the tenant in writing. Any costs and charges must be detailed in a separate account from the rent. If they are not included in a package, they must correspond to real expenses. The tenant thus has the right to request the landlord to provide a justification of the breakdowns sent to him.

Registering the lease and of the inventory

Once you have signed your lease, the owner has 4 months to register it. If the lease was not registered, the tenant can leave with no notice and no indemnity and the landlord may have to pay a fiscal fine.

Inventory of fixtures


This should be drawn up in the first month of occupation, preferably when the apartment is still empty (within the first two weeks in the case of a lease for less than one year), at the initiative of the landlord and/or the tenant. This inventory should be registered by the landlord with the lease. If the inventory is drawn up by an expert (choose your own or agree this with the landlord), the costs will need to be shared between the landlord and the tenant. The incoming inventory is a document which contains a detailed description of the state in which the apartment is found when the tenant moves in. In order to be valid, it must:

Be drawn up jointly (in the presence of both interested parties) ;
Be dated and signed by the landlord and the tenant ;

Be detailed. It is important to be vigilant when the inventory is being drawn up, and to record any defect or fault existing. This will be your protection when the lease is terminated, when another inventory will be drawn up and compared against the first. The tenant must return the property rented in the state in which he took it over. He must repair any damage, other than that caused by ageing, act of God or normal wear and tear on the property rented.

May not exceed 2 months’ rent. must be lodged in a bank account opened in the name of the tenant and may not be released except with the agreement of both parties or by a judgement in case of conflict. interest earned on the guarantee will be the property of the tenant when he leaves the property. the guarantee is used to cover any damage which the tenant may cause to the rented property or failure to abide by the rental termination clauses. You should never pay cash in hand. normally, you will be given the guarantee back at the end of your lease, after the final inventory.
